In response to the request of the Government of Ukraine, UNOPS opened an office in Ukraine in 2017, which provides a broad spectrum of services to the Government and the people of Ukraine. Currently, the office is classified as an Operations Centre, with a portfolio of projects exceeding USD 100 million, in the areas of rule of law, environment, energy efficiency, crisis recovery, good governance, human resources management, procurement, and logistics.

The Support for Rule of Law Reforms in Ukraine (hereinafter - PRAVO Police) is a project funded by the European Union that has the overall objective of supporting the strengthening of the policing, prosecution and civilian governance in Ukraine and to align them with the best European and International practices. On matters of substance, the project relies on the EU Advisory Mission (EUAM) to Ukraine.

The PRAVO Police is partnered with the following national agencies: the Ministry of Internal Affairs of Ukraine, the National Police of Ukraine (NPU), the Office of the Prosecutor General (OPG), the State Bureau of Investigations (SBI). Activities include providing technical support tailored to the needs of each individual agency, while some interventions address larger scale and cross-cutting issues, including inter-agency cooperation and data exchange. 

One such activity relates to the development and roll-out of a new integrated Electronic Criminal Case Management System (eCMS) – an electronic system to be used for the storage and exchange of data on criminal offences at the pre-trial investigation stage and, partially, on judicial proceedings. Its users are the OPG, the NPU, the Security Service of Ukraine (SSU), the National Anti-Corruption Bureau of Ukraine (NABU), the SBI, the State Fiscal Service of Ukraine, courts and others. An integrated system for the entire chain of Law Enforcement Agencies (LEAs) with investigative powers, will allow the streamlining of case management within and between stakeholder agencies in the processing and exchange of key case information and documents leading to prosecutions or other procedural conclusions or resolution of cases. This will contribute to more efficient electronic interaction among investigators, prosecutors and judges at the pre-trial investigation stage, speed up the decision-making process, decrease routine administrative processes and reduce their duration and costs.

Development of the system should be carried out in close coordination with each relevant agency and take into consideration each agency’s vision of the eCMS, their internal ICT landscape and specific needs (analytics, user interface, performance, etc.) and cybersecurity aspects. The new system will be based on modern information technologies and the best EU practices.

The support from the PRAVO Police will be in stages. As a starting point, the PRAVO Police will contribute to the planning of the preparatory stage which includes development of the action plan on eCMS development and coordination with relevant partners. The role of the OPG in this process will be critical. As an initial step, the OPG will establish the interagency-working group (IWG), and will facilitate its meetings. The IWG will be comprised of all relevant LEAs, courts, other governmental agencies and experts from EUAM and UNOPS. One key task of the IWG is to identify the parameters and functionality of the eCMS which will meet the expectations of its users and be in line with the best European standards for this type of system (the Concept of eCMS to be approved by IWG). The IWG will agree on the sequencing of actions (development and roll-out of eCMS in Ukraine), and on subsequent migration of data from (or interoperability with) the existing Unified Register of Pre-Trial Investigations (the ‘Register’).

The IWG will identify areas where additional work would be required prior to launching an eCMS, such as specific options within a fully-featured solution that would be acceptable to all relevant stakeholders. The ultimate outcome of IWG meetings would be a jointly agreed solution on how to achieve automation of the entire document flow pertaining to the pre-trial criminal investigation process. The IWG will elaborate on the options to increase the number of future users, as compared to the current Register user base, through providing access to the system for judges and defense attorneys.

The Lead Specialist on Development of e-Case Management System (Consultant) will work under the supervision and guidance of the Programme Manager of the PRAVO Police. He/she will work both within the PRAVO Police team and within a wider stakeholder group focused on law enforcement and judicial reform in Ukraine. Accordingly, in addition to the specific requirements of the role there are norms to respect and wider strategic advice that will be sought from the consultant.

The Consultant will be responsible for leading implementation of eCMS related activities under the PRAVO Police and will coordinate, on a daily basis, with the stakeholders on the development and delivery of eCMS related products. The Consultant will work closely with the ICT Specialist - eCase Management Systems (to be recruited by the PRAVO Police).

The selected candidate will be responsible for:

1)    Coordination with Stakeholders:

• Collaborate with the representatives of the EUAM, the Support Group for Ukraine (SGUA), the Delegation of the European Union to Ukraine (EUDEL) and national beneficiary institutions on the design and implementation of the eCMS;
• Cooperate with EU funded and other projects dealing with the establishment of the eCMS;

• Manage communications with the partners on eCMS related interventions and ensure stakeholders are aware of respective PRAVO Police’ activities, progress, exceptions and that they are in a position to accept products developed/procured by the PRAVO Police;
• Facilitate the information flows within the PRAVO Police team;
• Advise the partners on issues that may impact the achievement of their outcomes (including issues of sustainability and post project requirements such as maintenance);
• Advise counterparts on the development, operation and maintenance of eCMS solution delivered under the PRAVO Police.

2)    Delivery of PRAVO Police interventions on eCMS:

• Contribute to development, editing and monitoring the implementation of the Action Plan on eCMS and on the resources required (e.g., cost estimate based on market research), the funds used within the PRAVO Police and the possible funding gap;
• Provide support to the OPG with preparations to the meetings of the IWG, prepare draft documents, presentations and other materials on eCMS to be presented at the meetings;
• Provide support to the OPG in development of the Concept of eCMS to be approved by IWG, including developing proposals on the scope of the eCMS to be implemented within PRAVO Police support;
• Contribute to the interagency dialogue to ensure the visions of establishment of a new eCMS proposed by LEAs, Courts and other governmental agencies are taken into consideration while development of the Concept of eCMS, in order to reach the consensus of the future eCMS on such aspects as functionality and interoperability. The focus will be on the workflow driven processing and exchange of key case information and documents leading to prosecutions or other procedural conclusions or resolution of cases. As a result, the stakeholders will come to the joint decision on ownership of eCMS solution, sustainability, security and privacy issues, migration of data and the licensing scheme (described in the Concept of eCMS);
• Participate in the selection process of suppliers of eCMS products;
• Together with the ICT Specialist monitor and evaluate performance of service providers / suppliers.

• Attend meetings with stakeholder LEAs institutions and engage in discussions on identification of the user requirements for the new eCMS, on the development, operation and maintenance of eCMS which might be delivered under the PRAVO Police, considering best EU practices;

• Coordinate, on day-to-day basis, the PRAVO Police’ eCMS interventions to ensure the final products will be acceptable for all beneficiaries, and sustainable;
• Identify the potential risks, issues, and impacts arising from the implementation of the eCMS interventions as well as suggest to the Programme Manager and the IWG counter-measures for prevention;
• Contribute to development of technical specifications (ToR) for the procurement and delivery of eCMS products and solutions, including cost estimation;

3)    Procedures:

• Follow the Project Management Cycle Instructions and ensure that all organizational policy is complied with (UNOPS Organizational Directives and Administrative Instructions);

• Ensure compliance with project management standards as relates to work-plan development, budget management and reporting;
• The Consultant will ensure that the PRAVO Police activities related to eCMS and possible further development and delivery of the system meet the quality and sustainability requirements of UNOPS, beneficiaries and partners;
• Ensure that PRAVO Police’ activities are fully compliant with the national regulations and policies, as well as quality standards;
• The Consultant will facilitate consideration of good international practices and in particular inputs provided by the key stakeholders, primarily the EUAM.

The Consultant must bear in mind that all solutions must be capable of implementation within the PRAVO Police timescale and must demonstrably lead to more effective case management procedures because the implementation of this solution will be subject to a separate component within PRAVO Police support intervention. In case such solutions cannot be delivered by the PRAVO Police, the Consultant must escalate risks of non-delivery or incomplete delivery of products to PRAVO Police and to the stakeholders.

4)    Knowledge Management

• Lead on the establishment of efficient and effective PRAVO Police ICT tools and processes specifically related to eCMS
• Engage in the development of PRAVO Police ICT standards and strategies;
• Interact with HQ and ICT staff from UNOPS and the EUAM, the EUDEL, and national beneficiaries in the area to share and exchange information and expertise on applications and tools;
• Contribute to knowledge networks and communities of practice;
• Identify lessons learned and provide recommendations.

• The Consultant has provided quality inputs to the inclusive national process of interagency coordination on the development of eCMS – as relates to the development of the Concept of eCMS, requirements and specifications to eCMS and procurement of respective services from the suppliers
• The PRAVO Police’ eCMS products are developed in line with best international practices and standards, where applicable, and fulfil Ukrainian standards
• The PRAVO Police’ eCMS products are fit for purpose and sustainability is thoroughly considered, which is confirmed by the Programme Manager
• Good quality inputs provided in time as agreed-to with Programme Manager, according to the PRAVO Police’ plans and strategies.

• Bachelor’s degree in Project Management / related field or in legal, information sciences, computer sciences, mathematics, engineering with project management experience is required. 
• Master’s degree in the relevant field might be considered in lieu of some years of experience.
• Certification in IT Project Management is an asset.

• Minimum nine (9) years with Bachelor’s degree (or seven (7) years with Master’s degree) of progressive experience relevant for the assignment in the field of project management in IT or related area (e.g. infrastructure projects) is required.
• General knowledge of operation and functionality of IT systems at the national institutions relevant for the assignment is an assets and should be demonstrated in the CV of the candidate.
• Experience in implementing projects and/or designing in the area of e-document and/or e-case management system for a government agency is a strong asset. The candidate should provide evidence of working on similar to the development of eCMS assignments in the past.
• Previous experience working in the area of Rule of Law or with ICT infrastructure will be an asset.

• Fluency in written and spoken Ukrainian and English is required.
