Knowledge Management Specialist for Methodology and Procedures in Criminal Investigation and prosecution of Domestic Violence - retainer position

The United Nations Office for Project Services (UNOPS) helps the United Nations (UN) and its partners provide peace and security, humanitarian, and development solutions. UNOPS services cover infrastructure, project management, procurement, financial management and human resources. 

In response to the request of the Government of Ukraine, UNOPS opened an office in Ukraine in 2017, which provides a broad spectrum of services to the Government and the people of Ukraine. 

The Support for Rule of Law Reforms in Ukraine (PRAVO-Police) is a project funded by the European Union that has the overall objective of supporting the strengthening of the policing, prosecution and civilian governance in Ukraine, aligning them with the best European and international practices. On matters of substance, the project relies on the EU Advisory Mission (EUAM) to Ukraine.

The Project is partnered with the following national agencies: the Ministry of Internal Affairs of Ukraine, National Police of Ukraine (NPU), the Office of the Prosecutor General (OPG), the State Bureau of Investigation (SBI). Activities include providing technical support tailored to the needs of each individual agency, while some interventions address larger scale and cross-cutting issues, including enhancement of human resources management systems and specific skills.  

One of the Project's actions is aimed at supporting the Office of the Prosecutor General, developing methodology, guidelines and Standard Operating Procedures (SOPs) for prosecutors. This activity should create a foundation for enhanced business processes for Prosecutors in the field of domestic violence.  

The aim of the activity is to create a practical tool for all Prosecutors to use when investigating crimes of domestic violence. 

The Consultant will be involved in implementation of the activity aimed at developing the methodology, guidelines and Standard Operating Procedures (SOPs) for prosecutors. This activity should create foundations for enhanced business processes at the OPG and for Prosecutors in the field of domestic violence and will be closely connected to the activities on development of methodology of specialisation of prosecutors and cases assignment. 

The selected Consultant will be responsible for the analysis of the relevant definitions, laws and regulations and best European practices in the field of domestic violence, and the analysis of the business processes of prosecutors, police officers and other actors in Ukraine. He or she will be responsible for the coordination of workgroups (WGs) and interaction with other relevant authorities and key stakeholders in the development of the methodology and processes that will allow the different actors in the criminal justice system to operate in a coordinated and effective manner.

The Knowledge Management Specialist for Domestic Violence (hereinafter - Consultant) will work under the supervision and guidance of the Project Manager of the PRAVO-Police Project. While performing the assigned duties the Consultant will interact with the key stakeholders, primarily the OPG, a representative from the Prosecutor's Training Center of Ukraine (PTCU) and EUAM. The Consultant’s responsibilities and outputs are listed below.

At the first stage, the Consultant will engage with the OPG representatives to analyse business processes regarding the investigative actions related to domestic violence. At that stage, the Consultant will draft a short report with a summary covering the following (10 working days):

• Normative regulations and internal instructions which relate to the investigative actions performed by the prosecutors, police officers and other actors and best practices from the EU. The consultant may review UN or other international organizations’ experience and best practices on investigative actions related to domestic violence. This will include highlighting any area where the regulations or instructions are considered to be insufficient.
• Feedback from the OPG, NPU and other actors on the strengths and weaknesses (including gaps) of existing processes relevant to investigative actions.
• Proposed recommendations to the OPG regarding development of a comprehensive SOP in the field of investigative actions related to domestic violence.

At the second stage, the Consultant (with support of the OPG and EUAM) will coordinate the workgroup on development of new SOP for investigative actions. The consultant will lead working sessions online to moderate meetings on certain topics. As an outcome of this stage, the Consultant will draft a short report with a summary of the following (10 working days):

• Matters from a national and international/EU perspective discussed at the WGs with regard to the development of new SOP.
• Actionable solutions and recommendations of the WG members (OPG, NPU etc.) with regard to the development of new SOP for investigative actions.
• Legal or internal regulations which need to be introduced or amended to operationalise the new SOP.

At the third stage, the Consultant (in coordination with the OPG, PCTU, EUAM and other actors in the field of investigative actions) will develop a Final Report with the following sections (25 working days):

• The draft of the new SOP on procedural processes on Domestic Violence in line with EU’s best practices. 
• A structured analysis of the needs for practical training on the new SOP to be used at the PTCU, including the description of professionals at law enforcement institutions, which require such training (Units, numbers of male and female personnel). 

At all stages it is critical to ensure the gender dimension and the national ownership of the consultative process and of the solutions which will be promoted for adoption.

All key outputs will be delivered in English with the following translation into Ukrainian (covered by the PRAVO-Police). Ultimately, all materials will be translated into Ukrainian.

The services are expected to be delivered in accordance with the schedule which will be agreed with the national partners. Specifically, the following outputs will be expected from the Consultant:

Output 1
Short report at the first stage and presentation of the draft report to the OPG, EUAM and PRAVO-Police.
Timeline: Within one (1) month after the contract start date

Output 2
Short report at the second stage and presentation of the draft report to the OPG, EUAM and PRAVO-Police.
Timeline: Within three (3) months after the contract start date

Output 3
Final Report (including the draft SOP, guidelines, and the recommendations on training) and and presentation of the Final report to the OPG, EUAM and PRAVO-Police.
Timeline: Within five (5) months after the contract start date

• An advanced (master’s) university degree preferably in law, security management or social studies is required
• A relevant Bachelor’s degree in combination with additional two years of relevant professional experience would be accepted in lieu of Master degree

b. Work Experience 

• At least five (5) years with master’s degree or seven (7) years with bachelor’s degree of experience working in drafting documents in the field of prosecution, justice, investigation, or rule of law is required 
• Experience in the area of countering domestic violence is required
• Knowledge of Ukrainian criminal procedure would be considered as an asset
• Familiarity with the best international practices in investigating and prosecuting domestic violence would be considered as an asset

• Fluency in written and spoken English is required
• Working knowledge of Ukrainian and/or Russian will be considered as an asset
