2. Purpose and Scope of Assignment
This position will report to the Legal Advisor, under the supervision of the Deputy General Counsel and Director of the Legal Group.
The primary responsibilities of the Legal Specialist will be to provide legal advice on commercial and institutional matters in Latin-American and Caribbean Region (LCR), including, but not limited to, advising on the organization’s privileges and immunities, advising on the interpretation and application of UNOPS’ legal framework; advising on the design and drafting of legal procedures, rules and regulations; advising on disputes and claims; representing the Legal Group before internal and external stakeholders; identifying and proposing solutions to systemic legal issues, among others.
The Legal Specialist will be expected to work under the supervision of the Legal Advisor with a material degree of independence, and to drive several initiatives concurrently, meeting tight deadlines.
Main duties and responsibilities of the incumbent consist of those listed below:
1- Support to policy development and implementation

Review and comment on UNOPS’ rules and regulations, policies, manuals, templates, guidelines and standard documents.

Keep up-to-date on changes and developments to internal regulations, rules and policies and advise personnel on the applicable authority.

Advise on the interpretation and application of UNOPS internal framework, including its Financial Rules and Regulations, executive directives, operations instructions, and Procurement Manual, among others.
2- Advisory Services

Review, draft, negotiate and advise on host country agreements, and related legal documents and correspondence.

Advise on the organization’s privileges and immunities.

Advise and/or develop and institutionalize new approaches and standards relevant to the incumbent's area of expertise, in particular to adapt to changes in the legislative framework of countries in LCR.

Advise on day-to-day legal queries from the different Project Offices, which fall within LG’s purview.
3- Claims and Disputes

Advise on the merits of claims and disputes presented by third parties, participating in the design and implementation of legal strategies.

Advise on conciliation and arbitration proceedings.

Draft, review, advise on and negotiate, if applicable, legal documents relating to claims and disputes, including briefs, submissions, legal correspondence, settlements agreements, among others.

Represent the organization before external stakeholders, including counterparties, external counsel and arbitrators, among others.
4- Knowledge Building and Knowledge Sharing

Advise on the analysis of systemic legal issues and on the development and implementation of measures to address them.

Participation in corporate or regional forums/committees relevant to the practice.

Contribution to the development of LG’s legal knowledge management.

Conduct support missions to country offices in order to help in the implementation of processes or solutions, when required.

Deliver training for UNOPS’ personnel on topics under the LG’s purview;
5- Other Legal Support for LCR offices (mostly in Spanish) related to:

Review documents submitted to different internal areas where the Legal Group’s input and/or approval is required, including the Vendors Review Committee.

Represent the organization and the Legal Group before internal and external stakeholders.

Any other legal task that the Deputy General Counsel and Director for the Legal Group and/or the Legal Advisor deem convenient to entrust to the Legal Specialist from time to time.
