In response to the request of the Government of Ukraine, UNOPS
opened an office in Ukraine in 2017, which provides a broad spectrum of
services to the Government and the people of Ukraine. Currently, the office is
classified as an Operations Centre, with a portfolio of projects exceeding USD
100 million, in the areas of rule of law, environment, energy efficiency,
crisis recovery, good governance, human resources management, procurement, and
logistics.
The Support for Rule of Law Reforms in Ukraine (PRAVO Police) is a
project funded by the European Union that has the overall objective of
supporting the strengthening of the policing, prosecution and civilian
governance in Ukraine and to align them with the best European and International
practices. On matters of substance, the project relies on the EU Advisory
Mission (EUAM) to Ukraine.
The Project is partnered with the following national agencies: the
Ministry of Internal Affairs of Ukraine, the National Police of Ukraine (NPU),
the Prosecutor’s General Office of Ukraine (PGO), the State Bureau of
Investigations (SBI) and the Qualification and Disciplinary Commission of
Prosecutors. Activities include providing technical support tailored to the
needs of each individual agency, while some interventions address larger scale
and cross-cutting issues, including inter-agency cooperation and data
exchange.
One such activity relates to the development and roll-out of a new
integrated Electronic Criminal Case Management System (eCMS) – an electronic
system to be used for the storage and exchange of data on criminal offences at
the pre-trial investigation stage and on judicial proceedings. Its users are
the NPU, the Security Service of Ukraine, the National Anti-Corruption Bureau
of Ukraine (NABU), the SBI, the State Fiscal Service of Ukraine, the PGO,
courts and others. An integrated system for the entire chain of Law Enforcement
Agencies (LEAs) with investigative powers, will allow the streamlining of case
management within and between stakeholder agencies in the processing and
exchange of key case information and documents leading to prosecutions or other
procedural conclusions or resolution of cases. This will contribute to more
efficient electronic interaction among investigators, prosecutors and judges at
the pre-trial investigation stage, speed up the decision-making process,
decrease routine administrative processes and reduce costs.
Development of the system should be carried out in close
coordination with each relevant agency and take into consideration each
agency’s vision of the eCMS, their internal ICT landscape and specific needs
(analytics, user interface, performance, etc.) and cybersecurity aspects. The
new system will be based on modern information technologies and the best EU
practices.
The support from the Project will be in stages. As a starting
point, a Feasibility Study will be carried out, based on the steer given by the
interagency-working group (IWG), facilitated by the PGO. The group is comprised
of all relevant LEAs, courts, and experts from EUAM and UNOPS. One key goal of
the Feasibility Study is to identify whether the capabilities and functionality
of the existing Unified Register of Pre-Trial Investigations (Register) would
provide a sufficient basis for its upgrading to become the eCMS.
Based on the steer given by
the IWG, the Feasibility Study will identify the eCMS functional needs of all
LEAs. In addition, the Feasibility Study will identify areas where additional
work would be required prior to launching an eCMS system, such as specific
options within a fully-featured solution that would be acceptable to all relevant
stakeholders. Ultimately, the Feasibility Study could envisage how to achieve
automation of the entire document flow pertaining to the pre-trial criminal
investigation process. The Feasibility Study should also address the option to
increase the number of future users through providing access to the system for
judges and defense attorneys.
The ICT Specialist - eCase Management Systems (Consultant) will
work under the supervision and guidance of the Project Support Officer of the
PRAVO Police Project. She/he will work both within the PRAVO Police team and
within a wider stakeholder group focused on law enforcement and judicial reform
in Ukraine. Accordingly, in addition to the specific requirements of the role
there are norms to respect and wider strategic advice that will be sought from
the postholder. The Consultant will ensure that the PRAVO Police activities
related to the Feasibility Study on eCase Management and possible further
development and delivery of the system meet quality and sustainability
requirements of UNOPS, beneficiaries and partners. The Consultant must consider
the framework provided in the PRAVO Police Description of Action and other
relevant project documentation, relevant national policies and standards, good
international practices and taking into account the inputs provided by the key
stakeholders, primarily the EUAM. The selected candidate will deliver the outputs
listed below, in close cooperation with the ICT Advisor – eCase Management
Systems.
